Question by kiki: Can a person plead drug dependent in the state of ohio, and get the chance to do rehab?
A friend of mine is in jail now for fleeing and eluding, plus has charges filed against him for forgery. It’s their first time in trouble. They do have a drug problem. Will pleading drug dependant give this person the opportunity to seek drug treatment help and avoid prison or serving time. My friend is not an minor. Thanks, kiki

dug himself a pretty deep hole hun.. he might be able to do that if he can prove to the court that hard time isn’t the answer. Is this a first? second?.. if its a first.. then he might be able to plead it down.. try talking to the prosecutor.

Well, from the question, I would think there are three separate crimes enlisted in it 1.Fleeing and Eluding 2. Forgery. Yes, for these two crimes he has to face regular case and trial. If convicted will have to suffer jail sentences. Now regarding, drug abuse even if he is charged, he has to be treated because it has got available treatment. Moreover though it is prohibited by law in almost all countries of the world the Drug abuse/ addiction . It is a question of addiction and self injury Therefore, it is not seen as destruction of Public life and Public/Govt. property. Yes, the drug dealer, who is responsible for damaging Public life, is surely punishable under and country’s law. Here in this case the suspect should be allowed treatment facilities and recovery from the addiction,or after proper treatment and recovery he may be let off with a deterrant minor punishment depending on the of merit of case by case.Thanks.
