hello,

i have a friend that was arrested and pleaded guilty to 3 years suspended sentence (for poss of drugs 11377), 3 years probation, and 2 years Delancey Street (drug program) but got kicked out of the drug program for an arguement. He has been a fugitive for 10 years now and now wants to fix everything!

What will happen with the suspended sentence
How much time do you think he will do etc….

He will be given his original sentence, which was 3 years.

California’s prisons are far too crowded to put every non-violent drug offender in. He should contact an attorney in California and arrange to surrender. A voluntary surrender could result in a restoration to probation in one of California’s drug programs which have been enacted since his original offense. No guarantees, there is always a chance that the 3-year sentence could be imposed, but if he has been law abiding for the past 10 years I don’t think it likely. (BTW, with conduct credits a 3 year sentence equals about 16 months in prison.)
